THIS AGREEMENT is between LINDA JAMES(the “Artist”) and ________________________ (the “Commissioner”), by which we agree that:
- The Artist shall create the following proposed work (“Commission”):

- Price:
- Date of Delivery: _______________________________________ unless an unforeseen event occurs that could delay the delivery of said Commission. In case of such an event, Commissioner will be contacted and an alternate expected date of delivery will be agreed upon.
- Artist shall retain all rights in and title to the Commission until its completion and
delivery, receipt of final payment and signature of the Artist’s Bill of Sale.
- Artist continues to maintain copyright to the Commission (portrait and other art)
and maintains the right to display said work on Artist’s website, Artist’s brochure, flyer or
other means of advertising. (In the case of a portrait, an alias name can be used if
preferred.) Artist also retains the rights and title to the commissioned work for purposes
of limited edition and/or giclee prints (except in the case of portraiture).
- Commissioner may terminate this Agreement at any time by giving written notice
to the Artist. Also, if Commissioner is not satisfied with the Commission, Commissioner
has the right to terminate this Agreement and the balance of the Commission will not be
due. In the event of termination for any reason, Artist is entitled to retain the nonrefundable deposit and photography fee and also maintains all rights in and title to the Commission and it may be exhibited and sold elsewhere.

_____ A non-refundable fee of $50 is required for photography.
- This Agreement deals with the creation and sale of a work of art. It is understood
and agreed that Artist has a right to aesthetic freedom. Artist will strive to strike a
balance between the desires of the Commissioner and the Artist’s vision and
interpretation of the subject matter.
